Times-7 warrants that all Times-7-manufactured equipment will be free of any defect in materials or workmanship for 12 months, subject to the following terms and conditions. The warranty starts from the purchase date and applies to all equipment used for its intended purpose. Times-7 warrants that all Times-7-manufactured products supplied by Times-7 that have been installed and used as intended will be free of any defect in materials or workmanship for the Warranty Period
The Products specified in the Agreement
The Purchaser may order an extended Warranty for an Accepted Order within one month of the original shipment date for that Accepted Order at the relevant Price specified below. However, if an extended Warranty has been requested for custom-designed antennas, Times-7 will review the use case to assess the risks and determine the warranty Price and Warranty Period, which Times-7 will notify the Purchaser of in writing

This Warranty is subject to the warranty terms and conditions set out below.
7.1 Warranty
7.1.1 The Products are warranted against the defects and failures listed in the warranty coverage section of this Product Warranty Form for the Warranty Period (and any agreed extension period) specified in this warranty certificate (Product Warranty).
7.1.2 Only the Purchaser specified in this warranty certificate may make a claim under this Product Warranty. The warranty only applies to the original purchaser and is not transferable to any other person. Proof of purchase date and a copy of the relevant sales invoice will be required for a claim under this product Warranty.
7.1.3 This Product Warranty does not apply to components which are separate from the Product, including ancillary equipment and consumables, whether supplied by Times-7 or a third party.
7.1.4 This Product Warranty is subject to the “limitations and exclusions” listed in clause 7.4.
7.2 Warranty claims
7.2.1 Without limiting any Delivery inspection and notification obligations in your Agreement, all Product Warranty claims must be made by the Purchaser as soon as practicable upon becoming aware of the defect or failure, and no later than 10 after the expiration of the Warranty Period.
7.2.2 To make a claim, the Purchaser must contact Times-7 using the contact details specified above and provide the details set out in clause 7.5.
7.3.1 In the event of:
a) defect or failure covered by this Product Warranty occurring during the Warranty Period; or
b) a defect or failure covered by any warranty or guarantee required by applicable legislation, regulation, law, or otherwise that Times-7 cannot by law exclude,
provided that:
c) the Purchaser notifies Times-7 of such claim within the timeframe specified in clause 7.2.1 to enable Times-7 to determine the nature of any issue. Often, a satisfactory solution can be achieved without returning the affected Products;
d) the defective or failure is covered by this Product Warranty (as determined by Times-7, acting reasonably); and
e) the defect or failure was not caused by, or arose as a result of, any limitation or exclusion listed in clause 7.4
Times-7 will, at its option, repair or replace the affected Products at its cost.
7.3.2 If the claim is not covered by this Product Warranty, Times-7 will deliver the Products (or relevant part) back to the Purchaser, provide an explanation as to the reason why coverage is not available, and the Purchaser will be responsible for any transport, travel and labour costs incurred in dealing with the claim
7.3.3 Times-7 will determine whether a defective Product should be returned to it and, if so, will instruct the Purchaser on how to package and ship the Product (or relevant part) to the designated location. Times-7 will bear the cost of the transportation and will provide the Purchaser with a GRA number.
7.3.4 In respect of any Product Warranty claim, where Times-7 has attempted to repair the Product twice in respect of the same defect or failure, and the repair has not been successful, Times-7 will replace the Product (or relevant part thereof) at its cost.
7.3.5 To the maximum extent possible under applicable law, such repair or replacement will be the Purchaser‘s sole remedy (to the exclusion of all other remedies that may otherwise be available to the Purchaser) in respect of any defect or failure in (or damage to) the products (or any part of them).
7.4.1 The Product Warranty, together with Times-7’s obligations under clause 7.3, will not apply where the relevant defect or failure was caused by, or otherwise arose as a result of, any of the following:
a) failure of the Purchaser (or any of its personnel, contractors, representatives, agents or end customers (as applicable)) to use, operate, maintain or install the Products in accordance with the approved maintenance plan, Times-7 specifications, instructions or other written material made available by Times-7;
b) servicing by personnel, contractors, representatives, and agents who are not approved by Times-7 for operating and service.
c) misuse, improper installation, unlawful use, unauthorized repair, negligent handling or use, damage, improper storage, of the Products by the Purchaser (or any of its personnel, contractors, representatives, agents or end customers (as applicable).
d) modifications or attachments on or to the Products made or used by the Purchaser (or its end customers, as applicable), or any third party engaged by the Purchaser (or its end customers, as applicable), which were not provided or otherwise approved by Times-7;
e) events beyond the reasonable control of Times-7, including but not limited to flood, fire, theft, lightning, earthquake, or extreme hot or cold weather;
f) faults, damage or defects caused by third parties, including third party products or work done by unauthorised service providers;
g) damage caused in transit (including loading and unloading). Your Agreement sets out the process to be followed in the event that your Delivery inspection identifies damage caused during transit of the Products; or
h) the Products being packaged, labelled, modified, or sold by someone other than Times-7 (or by an authorized distributor of the Products).
7.4.2 Except to the extent prohibited or otherwise required by applicable consumer law, and except as expressly provided for in this Product Warranty, all warranties, representations, and guarantees in relation to the Products are excluded, including, without limitation, in regard to suitability, fitness for purpose, or quality.
7.4.3 To the fullest extent possible under applicable law, in no event shall Times-7 be liable for:
a) any injury or death as a result of improper, careless, or negligent installation or use of the Products;
b) any incidental or consequential damages, loss of profits, loss of anticipated savings or any other indirect or consequential damages; or
c) any costs or expenses incurred by the Customer for the procurement of substitute equipment or services.
